New Home Warranty

WARRANTY DURATION:

This home is warranted for a period of two (2) years from the settlement date of the original owner and is NOT transferable to future owners within the warranty period. Specifically noted structural items are warranted for Five (5) years from the settlement date of the original owner. Builder scheduled inspections are performed for the original buyer only.

WARRANTY COVERAGE:

This home is warranted against defective materials or workmanship that is further explained on the proceeding pages. This warranty is void if the home has been damaged by accident, unreasonable use, neglect, improper service, acts of Nature, or other causes not arising out of defects in material or workmanship. Only the house as originally delivered to the owner is covered under this warranty. Anything added to, or altered in, the home by the owner will void the warranty in that location.

WARRANTY DISCLAIMERS:

There is no express warranty of any kind, or implied warranty obligation (including, but not limited to, any implied warranty of merchantability, habitability, or fitness for a particular purpose) given or undertaken by Elite Home Builders, Inc. in connection with the construction or sale of the home, and relating to the quality or condition of any part of the home, except for this Warranty. No officer, employee or agent of Elite Home Builders, Inc. is authorized to grant any other express warranty or representation or undertake any implied warranty obligation beyond the provisions of this Warranty at any time.

Elite Home Builders, Inc. shall not be liable for incidental or consequential costs, expenses or damages incurred by the owner. In the event that the owner of the home has any past due sum of monies that are payable and owed to Elite Home Builders, Inc. beyond 30 days, of which Elite Home Builders, Inc. has given sufficient written notice regarding said payment delinquency to owner, Elite Home Builders, Inc. shall retain the right to terminate this warranty with written notice to owner and said warranty shall be deemed null and void and neither party shall have any rights, responsibilities or obligations to the other regarding the warranty.
